EAST EDEN, MN -- Milk Specialties Co. (MSC) has refused access by the U.S. Occupational Safety and Health Administration to an internal report of an alleged ComDust explosion that occurred at its Fon du Lac plant on Aug. 14.
MSC contends providing the report to OSHA would violate attorney-client privilege,according to the Fon dul Lac Reporter. OSHA reportedly had a subpoena issued as part of its investigation to determine if MSC employees were exposed to dust hazards.
On its website, Milk Specialties says it develops milk protein and whey-based products for the sport nutrition and healthy lifestyle industries.
OSHA is in the throes of gathering information with the intention of developing a workplace rule to regulate myriad forms of combustible dust, including wood dust.
