WASHINGTON, DC - A group of 198 mostly Chinese firms and related companies is listed in an inquiry into imports of wood bedroom furniture in 2011 - believed to be the largest such inquiry ever. The move comes just as federal agencies announced plans to pursue more aggressive enforcement programs to combat dumping and restrictive tariffs under a new Executive Order issued yesterday.

The complaint published in the Federal Register Feb. 29 lists 198 wood furniture companies in China who will now be investigated by the U.S. Department of Commerce. The period of the investigation covers furniture exported to the U.S. from January 1 through December 31, 2011. Firms listed can submit responses.
In the case of Quebec-based furniture giant Foliot, its company was included in the inquiry at its own request, says president Dan Foliot. Because it imports some furniture from China, Foliot said he initiated the request for an inquiry in order to "set the record straight and introduce transparency into the situation."
Foliot is moving aggressively to insource furniture manufacture to North America, Foliot notes, having opened a 300,000 square foot furniture manufacturing plant - Foliot Furniture Pacific - in Las Vegas.
“As of 2012, every importer should be asking for a review," says Foliot. "We iniated this on the advice of our lawyer, to make sure everything was done well. We don’t import more or less than other companies.
“We are growing here; we are creating jobs here; and we have no factories in China," he says. [An earlier version of this article mis-identified Foliot Furniture Pacific as a China-based subsidiary.]
The Commerce Department inquiry is set to be completed by 2013. An annual process under an original complaint that began in 2003, last year's Dept. of Commerce investigation found 36 firms were dumping. U.S. importers of Chinese wood bedroom furniture pay preliminary tariffs, then must pay additional penalties after the fact if they are found to have benefited from furniture whose manufacture or export was subsidized.
Last year's findings resulted in more than three dozen China wood furniture importers facing retroactive tariffs from 16% to over 200%. U.S. furniture manufacturers then share in these penalties to compensate them for lost business. That practice results in significant income for U.S. wood products firms. Furniture retailers have taken issue with the payments claiming they drive up retail furniture prices for consumers, and unfairly punish retailers who import.
Separately, an Executive Order signed by President Obama Feb. 28, established an Interagency Trade Enforcement Center (ITEC), expected to speed enforcement actions against foreign manufacturers suspected of dumping in numerous industries, including the furniture and other wood products industries, as well as those imposing restrictions on imports.
United States Commerce Secretary John Bryson said his agency "is committed to making it as easy as possible for U.S. businesses to build things here and sell them everywhere, because we know that when American businesses and workers get a fair shot, they can compete and win [and] make sure that our foreign trade partners play by the rules.”
The Interagency Trade Enforcement Center will serve as the primary forum within the federal government for U.S. Trade Representative and other agencies to coordinate enforcement of U.S. trade rights.
It is intended as a forum to encourage greater participation among U.S. workers and businesses to identify and eliminate unfair trade practices and barriers for export. ITEC operates under the Commerce Department’s International Trade Administration and the Office of the U.S. Trade Representative.
