RAPID CITY, SD – Masco Corp. filed a motion to dismiss a lawsuit seeking severance pay and damages filed on behalf of 157 people who worked at Merillat’s particleboard plant. Merillat is a division of Masco, based in Taylor, MI.
According to the Rapid City Journal, the workers claim they should have received severance benefits when Masco closed the mill. The plant was subsequently sold to Dakota Panel of Eau Claire, WI, a countertop manufacturer and most of the former Merillat employees were offered jobs.
In its court filing, Masco stated, “Plaintiffs have offered no plausible set of facts demonstrating how the terms of the alleged contract were definite enough to form an enforceable promise.”
